HONESDALE, PA -- Wayne County District Attorney A.G. Howell announces the following cases were addressed by the Honorable Janine Edwards, President Judge Wayne County Court:

DANIEL RICHARD COX, age 41 of Lakeville, PA, was sentenced to 12 months probation for two (2) counts of Disorderly Conduct (M3), one count of Duty of Driver on Approach of Emergency Vehicle (S), and one count of Fleeing or Attempting to Elude a Police Officer (M2). He was also ordered to pay the costs of prosecution, pay a fine of $25.00, and continue with mental health treatment and comply with any recommendations for treatment. The incidents occurred on October 30, 2019 in Paupack Township and December 31, 2020 in Salem Township.

JOEL B. FIGUEROA, age 26 of Bronx, NY, was sentenced to undergo incarceration in the Wayne County Correctional Facility for a period of not less than 17 days nor more than 12 months for one count of Simple Assault (M2), one count of Possession of Drug Paraphernalia (M), and one count of Harassment (S). He was also ordered to pay the costs of prosecution, have no contact with the victims, relinquish any firearm and any ammunition to law enforcement within 24 hours, pay a fine of $300.00. undergo a drug and alcohol evaluation and comply with any recommendations for treatment, and complete an anger management program. The incident occurred on April 9, 2021 in Lake Township.

ERIC GRANT, age 21 of Honesdale, PA, was sentenced to 12 months probation for one count of Defiant Trespass (M3), one count of Possession of Drug Paraphernalia (M), one count of Simple Assault (M2), and one count of Criminal Mischief (M3). He was also ordered to pay the costs of prosecution, undergo a drug and alcohol evaluation and comply with any recommendations for treatment, continue with mental health treatment and comply with any recommendations for treatment, and participate in anger management counseling. The incidents occurred on May 17 and May 18, 2021 in Honesdale Borough.

KRISTEN NICOLE GURATOSKY, age 31 of Greeley, PA, was sentenced to undergo incarceration in the Wayne County Correctional Facility for a period of not less than 158 days nor more than 23 ½ months for one count of Possession of Controlled Substance with Intent to Deliver – Heroin/Fentanyl (F). She was also to pay the costs of prosecution, undergo a drug and alcohol evaluation and comply with any recommendations for treatment, undergo a mental health evaluation and comply with all treatment recommendations, and obtain employment within 60 days of parole or provide documentation from a doctor precluding her from employment. The incident occurred on March 16, 2021 in Palmyra Township.

DAWN LEE HAINES (EVERARD), age 56, of Damascus, PA, was sentenced to undergo incarceration in a State Correctional Institution for a period of not less than 40 months nor more than 108 months for one count of Possession of Controlled Substance with Intent to Deliver-Methamphetamine and Fentanyl (F), one count of Endangering the Welfare of Children as Parent/Guardian (M1), done count of Driving Under the Influence of a Controlled Substance Schedule II or III (M1), one count of Possession of Drug Paraphernalia (M), and one count of Driving While Operation Privilege Suspended/Revoked (S). She was also ordered to pay the costs of prosecution, pay a mandatory minimum fine of $2,200.00, complete 100 hours of community service, participate in and cooperate with the drug and alcohol addiction treatment in accordance with her assessment, and complete the Alcohol Highway Safety Program. The incidents occurred on June 19, 2020 in Texas Township and August 27, 2020 in Berlin Township.

MICHAEL JENKINS, age 24, of Waymart, PA, was sentenced to undergo incarceration in the Wayne County Correctional Facility for a period of not less than 14 months nor more than 60 months for one count of Fail to Verify Address/Be Photographed (F3). He was also ordered to pay the costs of prosecution. The incident occurred on December 1, 2019 in Waymart Borough.

MICHAEL McCARTHY, age 24, of Lake Ariel, PA, was sentenced to undergo incarceration for a period of not less than 72 hours nor more than 6 months for one count of Driving Under the Influence of Alcohol/Schedule I Controlled Substance (M). He was also ordered to pay the mandatory minimum fine of $1,000.00, participate in and cooperate with the drug and alcohol addiction treatment in accordance with his assessment, complete the Alcohol Highway Safety Program, and obtain employment within 30 days of parole or provide documentation from a doctor precluding him from employment. The incident occurred on July 29, 2020 in Salem Township.

TYLER J. NEGLIA, age 21, of Hawley, PA, was placed on the Accelerated Rehabilitation Disposition Program for a period of 6 months related to a Boating Incident. He was also ordered to pay all costs, perform 20 hours of community service, and pay restitution in the amount of $5,766.95 The incident occurred on July 5, 2021 in Paupack Township.

PAUL MICHAEL PASCO, age 23, of Clarks Summit, PA, was sentenced to undergo incarceration in the Wayne County Correctional Facility for a period of not less than 4 months nor more then 23 ½ months for one count of Simple Assault (M2) and one count of Disorderly Conduct (S). He was also ordered to pay the costs of prosecution, undergo a drug and alcohol evaluation and comply with any recommendations for treatment, undergo a mental health evaluation and comply with any recommendations for treatment, complete an anger management program, pay a $200.00 fine, and relinquish any firearms and any ammunition to law enforcement. The incident occurred on January 15, 2021 in Salem Township.

KELLY M. POTTS, age 35, of Newfoundland, PA, was sentenced to undergo incarceration in the Wayne County Correctional Facility for a period of not less than 6 months nor more than 23 ½ months for one count of Possession of Controlled Substance-Methamphetamine (M), one count of Possession of Drug Paraphernalia (M), and one count of Retail Theft (S). She was also ordered to pay the costs of prosecution, pay a fine of $100.00, undergo a drug and alcohol evaluation and comply with any recommendations for treatment, undergo a mental health evaluation and comply with any recommendations for treatment, and obtain employment within 60 days of parole or provide documentation for a doctor precluding her from employment. The incident occurred on March 12, 2021 in Texas Township.

RYSENE TRAVIS PRICE, age 29, of Somerset, PA, was sentenced to 1-year probation for one count of Loitering and Prowling at Nighttime (M3) and one count of Possession of Drug Paraphernalia (M). He was also ordered to pay the costs of prosecution, undergo a drug and alcohol evaluation and comply with any recommendations for treatment, continue with mental health treatment and comply with any recommendations for treatment, and obtain employment within 60 days of parole or provide documentation from a doctor precluding him from employment. The incident occurred on April 4, 2021 in Lehigh Township.

ROBERT NATHAN SHUGER, age 37, of Honesdale, PA, was sentenced to undergo incarceration in the Wayne County Correctional Facility for a period of not less than 9 days nor more than 6 months for one count of Disorderly Conduct (M3), one count of Scattering Rubbish Upon Land/Stream Etc. (S), one count of Harassment (S) and one count of Public Drunkenness (S). He was also ordered to pay a fine of $250.00, complete 5 hours of community service, undergo a drug and alcohol evaluation and comply with any recommendations for treatment, and undergo a mental health evaluation and comply with any recommendations for treatment. The incident occurred on August 19, 2021 in Honesdale Borough.

BREANN BRESEE, age 25, of Greentown, PA, was issued a Bench Warrant for failure to appear in court.
