MILFORD, PA — Pike County District Attorney Raymond J. Tonkin announced the following criminal sentences were issued by Pike County Court of Common Pleas President Judge Gregory Chelak:
Thomas Paul Vitovic, age 30, of Sussex, NJ, was sentenced to 6 months of probation and a fine of $345 for the crime of Driving Under the Influence and the Summary Offense of Maximum Speed Limits. Vitovic was stopped by the state police for speeding and swerving across his lane of travel of Route 6 in Shohola Township on May 21, 2022. Vitovic was observed to have bloodshot, watery eyes and emanating the smell of an alcoholic beverage. Vitovic admitted drinking prior to driving. Field Sobriety Tests were conducted which showed numerous indicators of impairment and a breath test confirmed a blood alcohol content of .109%.
Liam Thomas McCann, age 26, of Port Jervis, NY, was sentenced to 14 months to 48 months in a state correctional facility and a fine of $1,400 for the crimes of Criminal Conspiracy, Unauthorized Use of an Automobile or Other Vehicles, Bad Checks and Theft. McCann issued a check at a business in Matamoras Borough in the amount of $841 on September 24, 2021, knowing that the check would not be honored by the bank. On October 6, 2021, McCann returned merchandise he did not pay for to a retail store in Westfall Township in exchange for a store gift card. On January 30, 2022, McCann took a Ford truck valued in excess of $2,000 from a utility company located in Milford Township without the permission of the company. On January 31, 2022, McCann unlawfully took possession of a Dodge truck containing tools and equipment valued in excess of $2,000 without the truck owner’s permission.
Eliana Habeebah-Ghanimah Wadud, age 20, of Hawley, PA, was sentenced to 6 months of probation and a fine of $300 for the crime of Possession of a Controlled Substance. The state police observed a vehicle, which Wadud was a passenger in, travel across the double yellow lines of SR 739 several times on January 21, 2023. When speaking with the driver and occupants, a nervous behavior was observed and an odor of an alcoholic beverage was detected. A consent to search the vehicle found Wadud in possession of Psilocybin.
David A. Fumanti, age 55, of Old Forge, PA, was sentenced to 3 months to 6 months in the Pike County Jail, fined $1,000 and had his driver’s license suspended for 12 months for the crime of Driving Under the Influence of Alcohol or a Controlled Substance. The state police were dispatched to a one-vehicle crash along SR 390 in Greene Township on March 15, 2022, where Fumanti drove off the road into a tree. Fumanti admitted to drinking beer prior to driving. A consent to search the vehicle revealed an open beer and drug paraphernalia. Field Sobriety Tests were conducted which indicated impairment. A white powder was observed in Fumanti’s nose. A blood test confirmed the presence of Methamphetamine, Amphetamine, THC, Alprazolam, Clonazepam and Amino clonazepam in his blood.
Nicholas Marino, age 57, of Totowa, NJ, was sentenced to 4 months to 23 months in the Pike County Jail and fined $300 for the crime of Theft by Deception. Marino presented a forged prescription for the purchase of Promethazine and Codeine at a drug store located in Milford Township between March 27, 2023, and April 5, 2023.
Van Joseph Soojian, age 35, of Sterling, PA, was sentenced to 12 months of probation and fined $1,000 for the crime of Unsworn Falsification to Authorities. Soojan applied for the purchase of a firearm through a business in Matamoras on April 11, 2023, and failed to disclose on the application that he was sentenced for the Felony Possession of a Controlled Dangerous Substance in New Jersey in 2010.
Lashawn Andrews, age 43, of Milford, PA, was sentenced to 46 days to 18 months in the Pike County Jail and fined $800 for the crimes of Recklessly Endangering Another Person and Criminal Mischief. The state police were dispatched to a business parking lot in Blooming Grove Township where Andrews was in a dispute with the business owner on March 18, 2022, during which Andrews drove her vehicle into the property owner’s gate, causing $500 in damages. When contact was made with Andrews, she was behaving belligerently and jumped into the driver’s seat of the vehicle, stepping on the gas and shifting the vehicle in gear while the trooper was reaching into the vehicle, putting the trooper at risk of injury.
Ciaran James McAllister, age 39, of Bushkill, PA, was sentenced to 6 months to 23 months in the Pike County Jail and fined $500 for the crime of Terroristic Threats. The state police responded to McAllister’s residence in Lehman Township for a domestic dispute on October 20, 2022. McAllister approached the troopers in an aggressive manner, attempting to instigate a physical confrontation. McAllister threatened harm to the responding troopers if they didn’t leave.
Trevor John Scott, age 35, of Strasburg, VA, was sentenced to 90 days to 5 years in the Pike County Jail, fined $2,500 and a driver’s license suspension of 30 months for the crimes of Driving Under the Influence, Driving While Operating Privilege is Suspended or Revoked, Resisting Arrest and Terroristic Threats. The state police stopped Scott for weaving his vehicle across his lane of travel of SR 739 in Delaware Township on January 27, 2023. When contact was made with Scott, an odor of an alcoholic beverage and Marihuana was detected. Scotts eyes were observed to be bloodshot, and he was exhibiting slurred speech. Scott refused to exit the vehicle when directed and had to be forcibly removed. Scott was found in possession of Marihuana. While being transported in the trooper's vehicle, Scott threatened to assault the troopers. Scott was found to be driving on a suspended license and refused to submit to a chemical test.
Nigel A. Tuten, age 31, of Tamiment, PA, was sentenced to 1 year to 4 years in a state correctional facility and fined $800 for the crimes of Firearms Not to be Carried Without a License and Possession with Intent to Manufacture or Deliver a Controlled or Counterfeit Substance. The Pike County Probation Officers conducted an unannounced field contact of Tuten at his residence in Lehman Township on March 23, 2021. During the visit, Tuten was found in possession of a loaded firearm and 33.42 grams of Marihuana, a grinder and fraudulent medical Marihuana labels.
Kayla Ann Lapolt, age 39, of Liberty, NY, was sentenced to 2 years of probation and a fine of $500 for the crime of Retail Theft. Lapolt took $592.52 in store merchandise from a retail store in Westfall Township on June 3, 2022, without paying full price for the items
