MOUNTAIN DALE - On December 3, 2024, Fallsburg Police responded to a residence in Mountain Dale for a report of an unknown subject on the property. The homeowner contacted the police and reported that he could see the individual on his camera.
Upon police arrival, fresh footprints leading to the front door were discovered and it appeared that forcible entry was made into the residence. The homeowner remained in contact with police and advised that the individual was inside the residence in a bedroom. Fallsburg police then made forcible entry into the residence, as both exterior doors were barricaded shut, and police then made forcible entry into the master bedroom, where the suspect was reported to be.
Police then located Malcom Guillory and he was taken into police custody without further incident. Fallsburg Police Detectives then processed the scene and Malcom Guillory was transported to police headquarters where he was charged with burglary in the second degree and criminal mischief in the 3rd degree, both felonies, along with petit larceny, a misdemeanor.
Malcom Guillory was then arraigned in the Town of Fallsburg Justice Court by the Honorable Judge Scheinman and then remanded to the Sullivan County Jail, set to appear in court at later date.
Criminal charges are merely allegations that a defendant has committed violations of the criminal law, and as such they are not evidence of guilt. All defendants have a presumption of innocence and are entitled to a fair trial, during which it will be the burden of the State of New York to prove guilt beyond a reasonable doubt.
