Felon sentenced in Monticello for possession of stolen loaded gun

Andre Davis, 28, of Monticello, was sentenced on January 28 in Sullivan County Court to 12 years in state prison and five years post-release supervision for his conviction for the possession of a stolen and loaded handgun.

District Attorney Jim Farrell said that Davis pled guilty to criminal possession of a weapon and admitted to possessing a loaded .40 caliber handgun on June 1, 2012, while in a car that was stopped by Monticello Police on Park Avenue in the Village of Monticello. Monticello Police were assisted by the Sullivan County Sheriff’s Department at the scene of the car stop.

The gun was found to be stolen in the State of South Carolina. Davis was sentenced as a second felony offender, having prior felony convictions for robbery and possession of controlled substances and marijuana.

Farrell said, “This was a stolen gun that belonged to a law abiding citizen, who had a right to possess it under the Second Amendment, and this convicted felon had no business possessing it and the lengthy state prison sentence here enforces the laws we already have in place to combat the illegal and unlawful possession of guns. The officers involved in this case removed this stolen gun from the streets and from the hands of a convicted felon. They confronted a dangerous situation and made sure no one was harmed.”
