Sentencing in Wayne County Courts

HONESDALE, PA- Wayne County District Attorney A.G. Howell announced the following cases was addressed by the Honorable Janine Edwards, President Judge Wayne County Court on May 5:

Tiffani Nicole Bird,23, of Madisonville, PA, was previously sentenced on February 21, 2021, to 60 months probation, related to a DUI-Controlled Substance schedule I (M1), and was resentenced to undergo incarceration in the Wayne County Correctional Facility for a period of 30 days to 60 months, with 60 days house arrest through the SCRAM program. She was also ordered to pay the costs of prosecution, pay the mandatory minimum fine of $2,000, perform 100 hours of community service, pay restitution in the amount of $150 and undergo a drug and alcohol assessment and comply with all recommendations for treatment. The defendant was found in violation of Parole when she violated several conditions including failing to report to and/or not contacting probation. 

Allen Conkling, 28, of Beach Lake, PA, was sentenced to undergo incarceration in the Wayne County Correctional Facility for a period of not less than one month nor more than 12 months for one count of Possession of a Controlled Substance – Liquid Methamphetamine. He was also ordered to pay the costs of prosecution, undergo a drug and alcohol evaluation, comply with any recommendations for treatment and obtain employment within 30 days of parole or provide documentation from a doctor precluding him from employment. The incident occurred on January 10, 2021, in Buckingham Township.

Bridget Fountain, 38, of Forest City, PA, was sentenced to undergo incarceration in the Wayne County Correctional Facility for a period of not less than eight months nor more than 23 ½ months for one count of Simple Assault and one count of Disorderedly Conduct-Engaging in Fighting. She was also ordered to pay the costs of prosecution, undergo a drug and alcohol evaluation, undergo a mental health evaluation, comply with any recommendations for treatment and have no contact with the victims. The incident occurred on Jan. 2 in Clinton Township.

Mitchell W. Gilpin, 24, of Lake Ariel, PA, was sentenced to undergo incarceration in a State Correctional Institution for a period of not less than 14 months nor more than 60 months for one count of Resisting Arrest or Other Law Enforcement, Possession of Drug Paraphernalia and one count of Possession of Controlled Substance – Methamphetamine. He was also ordered to pay the costs of prosecution. The incident occurred on Jan. 1, in Salem Township.

Joseph Anthony Langone, 30, of Honesdale, PA, was sentenced to 12 months probation for one count of Disorderly Conduct – Engaging in Fighting. He was also ordered to pay the costs of prosecution, pay a fine of $500, participate in anger management courses and have no contact with the victim. The incident occurred on August 27, 2021, in Honesdale Borough.

William Marcinkevich, 55, of Factoryville, PA, previously sentenced on January 11, 2018, to undergo incarceration in the Wayne County Correctional Facility for a period of not less than four months nor more than five years related to a DUI, was resentenced to undergo incarceration in the Wayne County Correctional Facility for the remainder of his sentence, which is January 11, 2023. The defendant was found in violation of his probation when he violated his multiple conditions including failing to report and/or contact probation as well as being arrested while on probation. 

Michael Morgan, 26, of Jermyn, PA, previously sentenced on June 18, 2020, to 12 months probation related to Simple Assault, was resentenced to undergo incarceration in the Wayne County Correctional Facility for 10 days. The defendant was found in violation of his probation when he violated numerous conditions including not residing at his approved address. 

Joseph Martin Wagner, 51, of Beach Lake, PA, was sentenced to undergo incarceration in the Wayne County Correctional Facility for a period of not less than six months nor more than 12 months for one count of Possession of a Controlled Substance – Marijuana and one count of Possession of Drug Paraphernalia. He was also ordered to pay the costs of prosecution, and undergo a drug and alcohol evaluation and comply with any recommendations for treatment. The incident occurred on July 9, 2021, in Berlin Township.

Charles O’Brian Whitmore, 57, of Equinunk, PA, was sentenced to six months probation with 72-hour house arrest with the Electronic and Alcohol Monitoring through the SCRAM program. He was also ordered to pay the costs of prosecution, pay the mandatory minimum fine of $1,000, participate in, cooperate with the drug and alcohol addiction treatment in accordance with his assessment and complete the Alcohol Highway Safety Program. The incident occurred on August 5, 2021, in Manchester Township.

Kenneth J. Witkowski, 51, of Lake Ariel, PA, was sentenced to pay a fine in the amount of $500 plus court costs for one count of Disorderly Conduct – Engaging in Fighting. The incident occurred on June 9, 2019, in Lake Township.

Francesco Angelo Gioffre, 21, of DeLand FL, was issued a Bench Warrant for failure to appear at court.

Christopher George Jones, 54, of Hawley, PA, was issued a Bench Warrant for failure to appear in court.

John Edward Strunk, 27, of Wurtsboro, NY, was issued a Bench Warrant for failure to appear in court.
