Pike County sentencing week of March 6

MILFORD, PA — Pike County District Attorney Raymond J. Tonkin announced the following criminal sentences were issued by Pike County Court of Common Pleas President Judge Gregory Chelak:

Frederick F. Leonetti, age 41, of Lake Ariel, PA, was sentenced to 12 months to five years in a state correctional facility, fined $1,700 and had his driver’s license suspended for 24 months for the crimes of Driving Under the Influence of Alcohol or a Controlled Substance and Driving While Operating Privilege is Suspended or Revoked.  Leonetti was stopped by the state police along I-84 in Dingman Township on July 14, 2021, for his failure to properly display his temporary registration.  During the stop, Leonetti displayed signs of nervousness.  A consent to search his vehicle revealed items of drug usage, Field Sobriety Tests showed impairment and a blood test confirmed the presence of THC in his blood.  Leonetti was also found to be driving on a suspended license. 

James M. Cathcart, age 54, of Dingmans Ferry, PA, was sentenced to six months to 23 months in the Pike County Jail and fined $1,500 for the crimes of Criminal Conspiracy to Commit Delivery of a Controlled or Counterfeit Substance and Criminal Use of a Communication Facility.  On August 18, 2019, Cathcart contacted an individual through the use of a cellular telephone and arranged for the delivery of Heroin/Fentanyl for individuals present at his residence.

Samantha Cross Ulrich, age 38, of Lewisburg, PA, was sentenced to five days to six months in the Pike County Jail, fined $300 and had her driver’s license suspended for 12 months for the crime of Driving Under the Influence.  Ulrich was stopped by the state police on November 14, 2021, after being observed driving erratically along SR 739 in Delaware Township.  An odor of an alcoholic beverage was detected.  Ulrich admitted to drinking prior to driving.  Ulrich’s eyes were observed to be bloodshot, glassy and watery.  Field Sobriety Tests showed impairment and a breath test confirmed a blood alcohol content of .088%.

Christopher Michael Leonardi, age 22, of Hawley, PA, was sentenced to 90 days to five years in the Pike County Jail, fined $1,500 and had his driver’s license suspended for 18 months for the crime of Driving Under the Influence.  Leonardi was stopped by the state police on November 12, 2021, for traveling along SR 590 in Lackawaxen Township with a registration light out.  When speaking with Leonardi, the trooper observed him to have bloodshot, glassy eyes and emitting the smell of an alcoholic beverage.  Leonardi admitted to drinking prior to driving.  Field Sobriety Tests indicated impairment and a breath test confirmed a blood alcohol content of .165%.

Cindy L. Tanner, 44, and Michael Taggart, 44, of Bushkill, PA, were each sentenced to seven years of probation and fined $500 for the crime of Theft.  An audit of a community in Delaware Township revealed that while employees of the community, Taggart and Tanner made deposits in excess of $100,000 in funds taken from the community into their personal bank accounts between November 29, 2015 and January 1, 2017.

Anthony Joseph Pascavage, age 32, of Hawley, PA, was sentenced to 48 hours to 6 months in the Pike County Jail, fined $500 and had his driver’s license suspended for 12 months for the crime of Driving Under the Influence.  The state police were dispatched to a service station in Palmyras Township where Pascavage was parked at a gas pump and slumped over the steering wheel of his vehicle which was running.  When Pascavage was roused, he was observed to have bloodshot, watery eyes and displaying slow and delayed actions.  Pascavage admitted to drinking prior to driving.  Filed Sobriety Tests were conducted, and a breath test confirmed a blood alcohol content of .136%.

Richard Allan Hannon, age 45, of Wilkes-Barre, PA, was sentenced to 60 days in the Pike County Jail and fined $300 for the crime of Driving While Operating Privilege is Suspended or Revoked.  The state police stopped Hannon along SR 739 in Blooming Grove Township on June 14, 2021, for driving on a suspended license which was a result of a prior DUI conviction.

Michael A. Chalhoub, age 56, of Milford, PA, was sentenced to one year of probation and fined $500 for the crime of Persons Not to Possess, Use, Manufacture, Control, Sell or Transfer Firearms.  The Pike County Sheriff’s Department found Chalhoub in possession of firearms after having been convicted of a Felony possession of a controlled substance in New York Supreme Court in 2000.

Nicklus Andrew Jermion, age 24, of Dingman’s Ferry, PA, was sentenced to five years of the Pike Care Program which will include 90 days of house arrest, a fine of $1,500 and a driver’s license suspension of 18 months for the crime of Driving Under the Influence.  The state police stopped Jermion on August 15, 2021, after observing Jermion move his vehicle in and out of his lane of travel along Milford Road in Delaware Township.  When speaking with Jermion, the trooper detected the smell of Marihuana.  Jermion was observed to have bloodshot, glassy eyes, and slow, sluggish speech.  Jermion admitted to smoking Marihuana. Field Sobriety Tests indicated impairment and a blood test confirmed the presence of THC in his blood.

Rafael Ricardo Aguirremahecha, age 60, of Ridgefield, NJ, was sentenced to six months of probation and fined $300 for the crime of Driving Under the Influence. The state police observed Aguirremahecha swerve across his lane of travel along SR 739 in Dingman Township on September 4, 2022.  When contact was made with Aguirremahecha, he was observed to have glassy, bloodshot eyes and emitting an odor of an alcoholic beverage.  Aguirremahecha admitted to drinking prior to driving.  Field Sobriety Tests indicated impairment.  Aguirremahecha was unable to provide an adequate breath sample.

Ricky Scott Anello, age 33, of Medford, NY, was sentenced to one month to six months in the Pike County Jail, followed by 6 months of probation and a fine of $600 for the crimes of Possession of a Controlled Substance and Possession of Drug Paraphernalia.  The Eastern Pike Regional Police were dispatched to a business parking lot in Westfall Township where Anello was acting in a suspicious manner in his truck on April 8, 2022.  When contact was made with Anello, an odor of Marihuana was present in his vehicle, and he was observed to have red, glassy eyes with pinpoint pupils and displaying shifting moods.  Anello was found in possession of Psilocybin mushrooms and various items of paraphernalia, including glass pipes, hypodermic needles, plastic baggies and jars.  Anello refused to submit to a chemical test. 

Virgil Clay Dunkley, age 35, of Milford, PA, was sentenced to six months of probation and a fine of $300 for the crime of Disorderly Conduct.  Eastern Pike Regional Police responded to Roberts Lane in Westfall Township on July 1, 2022, where Dunkley relayed that he was going to shoot an individual.  Dunkley continued to harass the individual after he was asked to leave him alone.  

Garret L. Wilson, age 33, of Milford, PA, was sentenced to five days to six months in the Pike County Jail, fined $375 and had his driver’s license suspended for 12 months for the crime of Driving Under the Influence and the Summary Offense of Registration and Certificate of Title Required.  Wilson was stopped on May 27, 2022, when he was observed crossing the fog line on SR 739 in Dingman Township several times.  When speaking with Wilson, the trooper observed him to have bloodshot, glossy eyes and emanating an odor of an alcoholic beverage.  Wilson admitted drinking prior to driving.  Field Sobriety Tests showed impairment and a breath test confirmed a blood alcohol content of .10%.  Wilson was found to be driving an unregistered vehicle.

Zachary Clayton Seese, age 39, of Canadensis was sentenced to 45 days to six months in the Pike County Jail, fined $1,000.00 and had his driver’s license suspended for 12 months for the crime of Driving Under the Influence. Seese was stopped along Roemerville Road in Greene Township on June 11, 2022, for driving with an expired registration.  When speaking with Seese, the trooper detected the smell of an alcoholic beverage. Seese admitted to drinking prior to driving.  Field Sobriety Tests indicated impairment and a breath test confirmed a blood alcohol content of .122%. 

Bridget A. Tworkowsky, age 33, of Shohola, PA, was sentenced to five years of the Pike Care Program which will include 90 days of house arrest, a fine of $1,500 and a driver’s license suspension of 18 months for the crime of Driving Under the Influence.  The state police responded to Parkers Glen Road in Shohola Township on July 31, 2022, where Tworkowsky had crashed her vehicle.  Upon speaking with Tworkowsky, she admitted to drinking prior to driving.  A blood test confirmed a blood alcohol content of .218%.

Jason Anthony Recino, age 42, of Greentown, PA, was sentenced to 12 months to 24 months in a state correctional facility and fined $500 for the crime of Persons Not to Possess, Use, Manufacture, Control, Sell or Transfer Firearms.  The state police stopped Recino while traveling along SR 434 in Shohola Township for a tail light out.  A consent to search the vehicle revealed a firearm.  Recino had been previously convicted of a Felony preventing him the authorization to carry a forearm.

Brandon Thomas Lebron, age 26, of Milford, PA, was sentenced to 48 hours to six months in the Pike County Jail, fined $800 and had his driver’s license suspended for 12 months for the crime of Driving Under the Influence.  The state police stopped Lebron while traveling along SR 739 in Delaware Township on February 4, 2022, for an expired registration and his failure to use his turn signal.  When contact was made with Lebron, he was observed to have glassy, bloodshot eyes and emitting the smell of an alcoholic beverage and Marihuana.  Field Sobriety Tests showed impairment and a breath test confirmed a blood alcohol content of .114%.  Lebron was found in possession of Marihuana and Marihuana edibles. 

Marshall Ian Peter Moore, age 28, of Milford, PA, was sentenced to five years of the Pike Care Program which will include 90 days of house arrest, a fine of $1,500 and driver’s license suspension of 18 months for the crime of Driving Under the Influence.  The state police stopped Moore while traveling along Silver Lake Road in Delaware Township on August 1, 2019, for an obscured plate.  A search of Moore’s vehicle revealed a syringe and empty glassine packets.  Moore admitted to using Heroin prior to driving and was observed to have recent needle marks on both arms.  Moore refused to submit to a blood test.

Robert Anthony Colao, age 27, of Port Jervis, NY, was sentenced to 72 hours to six months in the Pike County Jail, followed by 18 months of probation, fined $1,300 and a driver’s license suspension of 12 months for the crimes of Driving Under the Influence of a Controlled Substance and Possession of a Controlled Substance.  Eastern Pike Regional Police came upon Colao overdosing in his vehicle that had driven down the embankment of Route 6 & 209 in Westfall Township on August 3, 2018.  Colao was unconscious with his vehicle running and a hypodermic needle in plain view.  Colao was revived with Narcan.  Colao refused to submit to a blood test.  Colao sold Heroin/Fentanyl to a confidential informant on March 1, 2019, in Matamoras.

Daryl Leon Newkirk, age 21, of Port Jervis, NY, was sentenced to 15 months to 36 months in a state correctional facility and fined $1,000 for the crime of Robbery.  Eastern Pike Regional Police responded to a business in Matamoras where a victim was seeking help after Newkirk and two additional individuals had followed him and brandished a BB gun in an attempt to rob him of his shoes on May 24, 2022.

Patricia Ann Cielinski, age 56, of Dingmans Ferry, PA, was sentenced to 72 hours to six months in the Pike County Jail, followed by 2 years of probation, a fine of $1,300 and driver’s license suspension of 12 months for the crimes of Driving Under the Influence and Resisting Arrest or Other Law Enforcement.  The state police observed Cielinski drive her vehicle across the double yellow lines of Child Park Road in Delaware Township numerous times on May 1, 2022.  Cielinski ignored the trooper’s attempt to pull her over, continuing to drive before eventually pulling into a driveway.  Cielinski refused to open her car door and exit the vehicle.  Cielinski was removed from the vehicle and an odor of an alcoholic beverage was detected.  Field Sobriety Tests indicated impairment and a breath test confirmed a blood alcohol content of .174%.
