Pike County sentencing — Mar 27

MILFORD, PA — Pike County District Attorney Raymond J. Tonkin announced the following criminal sentences were issued by Pike County Court of Common Pleas President Judge Gregory Chelak:

Sean M. Kraft, age 41, of Milford, PA, was sentenced to a fine of $300 for the crime of Disorderly Conduct.  The state police were dispatched to a residence in Dingman Township on January 12, 2023, where Kraft was involved in a physical altercation with an individual which resulted in bodily injury.

Tasheem Akeem Burden, age 31, of Pittston, PA, was sentenced to a fine of $400 for the crime of Possession of a Small Amount of Marihuana.  On December 4, 2021, the state police stopped Burden when he was observed operating his vehicle with an inoperable brake light along SR 507 in Palmyra Township.  Upon speaking with Burden, the trooper detected the smell of Marihuana.  A consent to search the vehicle revealed possession of Marihuana. 

Michael Jacob Rogers, age 19, of Shohola, PA, was sentenced to  24 months of probation and a fine of $500 for the crime of Corruption of Minors.  On August 27, 2022, Rogers, while employed as a security guard for a community in Delaware Township, approached two minors and encouraged them to smoke Marihuana with him knowing that they were under 18 years of age.

Marlin Yovani Perez-Miranda, age 32, of Dayton, OH, was sentenced to 12 months to 24 months in a state correctional facility and fined $500 for the crime of Firearms not to be Carried Without a License.  Perez-Miranda was stopped by the state police for speeding along I-84 in Blooming Grove Township on March 13, 2022.  A consent to search the vehicle revealed a pistol which Perez-Miranda did not have a license to carry.

Joseph William Harris, age 31, of Milford, PA, was sentenced to 72 hours to 6 months in the Pike County Jail, fined $1,000 and had his driver’s license suspended for 12 months for the crime of Driving Under the Influence of Alcohol or a Controlled Substance.  The state police stopped Harris on May 11, 2018, for traveling very slowly and erratically in a suspiciously low vehicle with an exhaust pipe dragging and sparking.  When the trooper encountered Harris, he detected the smell of Marihuana and observed him to have red eyes with droopy eyelids and slurred speech.  Harris admitted to smoking while he was driving. Field Sobriety Tests showed impairment and a blood test confirmed the presence of THC in his blood.

Christopher J. Baluta, age 56, of Tafton, PA, was sentenced to 12 months of probation, fined $3,500 and had his driver’s license suspended for 18 months for the crime of Accidents Involving Damage to Attended Vehicle/Property and the Summary Offense of DUI While Operating Privilege is Suspended or Revoked.  The state police responded to SR 507 in Palmyra Township where Baluta was involved in a collision with a motorcycle on June 25, 2022.  Baluta was found to be driving on a suspended license which was the result of a prior DUI.

James Cameron Secor, age 22, of Poughkeepsie, NY, was sentenced to 1 year of probation and fined $300 for the crime of Harassment.  Secor communicated via social media from a residence in Dingman Township on October 7, 2021, threats that he intended harm to an individual and that he was familiar with the entrance locations of the residence causing fear to the individual and his family.

Jose L. Marrero, age 47, of Milford, PA, was sentenced to 12 months to 24 months in a state correctional facility and fined $1,000 for the crime of Criminal Use of a Communication Facility.  The Pike County District Attorney’s Office Criminal Investigation Division served a search warrant on a hotel room in Westfall Township on March 20, 2021, and found Marrero had used a cell phone to arrange for the delivery and sale of Heroin.

Thorin Daye, age 21, of Milford, PA, was sentenced to 11 ½ months to 23 ½ months in the Pike County Jail, followed by 2 years of probation and a fine of $1,000 for the crimes of Corruption of Minors and Indecent Assault.  Between October 2021 and April of 2022, Daye had indecent contact with a minor at a residence in Dingman Township.

Mario Rodriguez, age 40, of Wilkes-Barre, PA, was found guilty after a Non-Jury Trial on January 11, 2023, and was sentenced to 5 days to 6 months in the Pike County Jail, a fine of $1,475 and a driver’s license suspension of 18 months for the crimes of Driving Under the Influence, Reckless Driving, Careless Driving, Driving on Roadways Laned for Traffic, False Reports and Investigation by Police Officer.  The state police were dispatched to SR 507 in Palmyra Township where Rodriguez was involved in a one-vehicle crash.  Rodriguez denied being the driver of the vehicle.  Rodriguez admitted to drinking prior to driving. Rodriguez refused to submit to a chemical breath test.

Ana Marina Rubio, age 38, of Monroe, NY, was found guilty during a trial conducted January 30, 2023 and was sentenced to 5 days to 6 months in the Pike County Jail, fined $650 and had her driver’s license suspended for 12 months for 2 counts of the crime of Driving Under the Influence, 1 count of Careless Driving, and Driving on Roadways Laned for Traffic. The state police responded to SR 590 in Lackawaxen Township where Rubio had rolled her vehicle over.  Rubio was observed to have watery, bloodshot eyes and smelling of an alcoholic beverage.  Rubio admitted to drinking prior to driving.  A breath test confirmed a blood alcohol content of .097%.
