New York Dems allowed to vote for Bernie in primary

NEW YORK STATE — A federal appeals court ruled on May 19 that the New York State Board of Elections (BOE) must hold a Democratic primary on June 23, and the ballot must contain the names of Sen. Bernie Sanders and all of the other candidates who would have legitimately been on the ballot this year. The BOE canceled the primary in April after Sanders and all of the other candidates had officially pulled out of the race, leaving former Vice President Joe Biden as the presumptive nominee.

That prompted a lawsuit filed by former candidate Andrew Yang and several others. The lower court ruled against the BOE and the appellate court ruled the same way. The BOE said it will not appeal this decision by the court and will move ahead with the election.

The state will not appeal further, meaning the contest is now guaranteed to be held. BOE Democratic Chairman Doug Kellner told Politico, “We have decided that four judges have spoken and the board has a heavy workload ahead of itself in order to pull together dealing with the primary election during this public health emergency.” 

Voters will have options on how to vote. The polling stations will be open on election day. People may also vote early. In Sullivan County, there will be one early-voting site at the government center. People also have the option of voting by mail. 

According to information on the state BOE website, Gov. Andrew Cuomo has issued executive orders requiring county boards of elections to “mail absentee ballot applications to all eligible active and inactive voters.” 

But individuals may also apply for absentee ballots online without waiting for the application to appear in the mail. The application can be found at www.elections.ny.gov/votingabsentee.html.

Upon completion, applications must be mailed, emailed or faxed to the resident’s county BOE no later than the seventh day before the election or delivered in person no later than the day before the election.

A voter may also request an absentee ballot by sending a letter to their county BOE. The letter must be received by the county board no later than seven days before the election. The letter must contain the following information: name and date of birth, the address where you are registered, an address where the ballot is to be sent and the reason for the request.
