LIBERTY, NY — On July 16, at approximately 6:20 p.m. officers with the Village of Liberty Police Department were dispatched to a reported structure fire at the Liberty Commons Apartment Complex.
Officers arrived on the scene and observed visible smoke billowing out of the residence. Firefighters were able to get the fire under control and confirm that there were no people inside the enflamed apartment. After a thorough police investigation by the Liberty Police Department and Sullivan County Bureau of Fire Arson Investigators, it was determined that the apartment tenant, Davina Holden, 56, of Liberty, had purposely set the apartment ablaze using an accelerant and a lighter.
Holden was arrested and processed by the Village of Liberty Police Department. Holden was charged with Arson 2nd (a class B felony), and reckless endangerment 1st (a class D felony). Holden was arraigned in the Town of Liberty Court and remanded to the Sullivan County Jail without bail.
Criminal charges are merely allegations that a defendant has committed violations of the criminal law, and as such they are not evidence of guilt. All defendants have a presumption of innocence and are entitled to a fair trial, during which it will be the burden of New York State to prove guilt beyond a reasonable doubt.
