Loch Sheldrake man sentenced for robbery

MONTCELLO, NY — A 26-year-old Loch Sheldrake man has been sentence for a robbery he allegedly committed  at the Mobil Gas Station on Route 52 in Fallsburg.

Sulllivan County District Attorney Jim Farrell Said that Ricardo Dias was sentenced to 8 ½ years in state prison and five years of post-release supervision.

The robbery rook place in November 2016.  According to Farrell Diaz pleaded guilty to second degree robbery, and admitted to entering the establishment with what appeared to be a semi-automatic handgun, pointing it at the cashier and demanding money.

 Diaz fled the gas station with approximately $800.00 in cash but was arrested a short time later by officers from the New York City Department of Environmental (DEP) Protection Police, who responded to a call of a robbery in progress. 

Police recovered the stolen money and a pellet pistol that looked like a real semi-automatic handgun.  Farrell said, “The quick action of our DEP and Fallsburg Police officers ensured that this defendant, who pointed a gun at a clerk and forcibly stole cash, was held responsible and accountable for this robbery.  Although the gun was not real, the clerk could not have known that, and he was frightened that he might be shot.” 

Diaz, who has a prior felony robbery conviction in Connecticut in 2010,  was sentenced as a second felony offender having a prior robbery conviction in Connecticut in 2010. 

A co-defendant, Patrick Toohey, 26, also of Loch Sheldrake, who was also charged with acting in concert with Diaz, is awaiting trial.
