Lake Adventure lawsuit settled

On October 1, Lake Adventure Community Association’s two-year battle with Dingman Township concluded with a ruling by Judge Joseph F. Kameen. The challenge to an ordinance was granted, and the part of the ordinance defining a recreation vehicle as a unit that does not require a special highway moving permit is stricken from the ordinance.

“Lake Adventure is ecstatic over this ruling,” said attorney Tammy Lee Clause, Lake Adventure Community Association’s legal counsel. “Lake Adventure property owners are now permitted to have one-piece, 400-square-foot recreation vehicle park models, even if they require a special hauling permit.”

The ruling said: “The restriction on RVs that require special highway permits… is not in conformity with the requirement that the ordinance promote public health, safety or welfare. This Court finds no evidence that restricting RVs requiring special hauling permits will promote the public health and safety.”
