Tusten zoning vote delayed

On advice from land-use attorney Mark Sweeney, the Town of Tusten Town Board has delayed the meeting at which it will vote on its zoning rewrite from Monday, November 14 to Monday, November 28 at 6:30 p.m. at the Tusten Town Hall on Bridge Street.

According to law, the finalized draft of the ordinance is supposed to be available online at least seven days before any vote; but in this case certain features of the ordinance, including a map, did not become available for integration until too late to satisfy the requirement.

Although Sweeney opined that the last-minute changes were minor enough that they might well withstand a challenge, it was agreed that it would be preferable to wait until the required statutory period had elapsed. The final version is online at www.tusten.org.
