Fallsburg Man found Guilty of Predatory Sexual Assault Against a Child

Sullivan County District Attorney Jim Farrell announced today that Noel Russell, age 37, of South Fallsburg, N.Y., was found guilty of two counts of Predatory Sexual Assault, class A-2 felonies, two counts of Predatory Sexual Assault Against a Child, class A-2 felonies, and two counts of Incest in the 1st Degree, class B felonies, after a jury trial in Sullivan County Court in front of County Court Judge Michael McGuire.

Farrell said the jury found Russell guilty of engaging in a course of sexual conduct with an eleven year old girl over a period of approximately nine months commencing in September of 2010 and continuing through March 2011 and engaging in a criminal sexual act with the same child in July of 2010.

Russell was charged with Predatory Sexual Assault because he had a prior rape conviction in 2005 that served as a basis to enhance the penalties he faced as a repeat sexual offender.

Russell admitted that prior conviction outside the presence of the jury, so they were not able to consider that fact in rendering a verdict. Russell was arrested in March of 2011 after an investigation by the Sullivan County Family Violence Response Team. The jury deliberated for about 14 hours before returning a verdict.

Farrell was “extremely pleased” with the jury’s verdict and praised the hard work of his staff and the members of the FVRT, “ADA Jared Hart and the members of the team worked very hard on this case to obtain justice for this young girl and the jury’s verdict will ensure that a predatory sexual offender will be removed from the community for an extended period of time.” Russell faces a minimum of 10 years to life up to 25 years to life when he is sentenced on May 9, 2012.
